California business and professional code 19008.1 states "Used" means mattresses that has been previously owned or used by another individual.
It is illegal to sell mattresses that has been previously owned or used by another individual as “New”. They must be marked and sold as either used or rebuilt and have a red or yellow law label. “New” mattresses have a white law label.
I don’t know of any manufacturer that will take back a “used” mattress from a retailer because their customer did not like it. When a mattress retailer takes back a mattress for refund or exchange, and they do not have a “used mattress sales section” in their store, chances are that it is going back into their stock and being resold as “New” to the next customer. You as the consumer do not know if you are getting a truly “New” mattress or a “Used” mattress that someone has tried and returned. Also think about the bedbugs that came back to the store in that returned mattress and may now be getting into the “New” mattresses.
Think of all the stuff you do on your mattress. Now think of sleeping in someone else's stuff. Would you wear someone else's underwear or lingerie? What about bed bugs? Ewwwww.
